These Terms of Service govern your use of the Viliante website, online store, products, services, and related customer experiences. By visiting our website, placing an order, creating or using an account, or otherwise using our services, you agree to these Terms and the policies referenced below.

Using Viliante

You may use our website and services only for lawful purposes and in accordance with these Terms. You are responsible for providing accurate, current, and complete information when you place an order, contact us, or create an account.

If you create or use a customer account, you are responsible for maintaining the confidentiality of your account access and for activity that occurs through your account.

Products & Availability

We make reasonable efforts to present our products, descriptions, images, specifications, pricing, and availability accurately. Product appearance may vary slightly depending on your device, display settings, packaging updates, or manufacturing changes.

Products and quantities may be limited, modified, replaced, or discontinued at any time. We may limit sales by person, household, business, geographic area, or order when reasonably necessary.

Orders & Payments

Submitting an order is an offer to purchase from Viliante LLC. An order is accepted when we confirm or process it. We may refuse, cancel, or limit an order when reasonably necessary, including in cases involving suspected fraud, incorrect pricing, inventory issues, payment problems, delivery restrictions, or other operational concerns.

You agree to provide accurate billing, payment, contact, and delivery information and to use a payment method that you are authorized to use.

Payments are processed through Shopify and available payment providers. Your use of a third-party payment service may also be subject to that provider's terms and privacy practices.

Pricing, Discounts & Promotions

Prices, discounts, shipping charges, promotions, and product availability may change without notice. The amount shown and accepted during checkout controls the price for that transaction, subject to correction of obvious errors.

Promotional offers may have additional conditions, expiration dates, quantity requirements, geographic restrictions, or other eligibility rules displayed with the offer.

Shipping & Delivery

Shipping and delivery options, prices, and estimated delivery times are shown during checkout when available. Delivery estimates are not guarantees and may be affected by carriers, weather, address issues, holidays, inventory, or events outside our reasonable control.

Local delivery and California delivery eligibility may depend on the delivery address, order quantity, and the delivery options available at checkout.

Cancellations, Returns & Refunds

Cancellation, address-change, or quantity-change requests should be submitted as soon as possible. We cannot guarantee that an order can be changed or cancelled after processing or fulfillment has begun.

Returns, refunds, replacements, and related eligibility are governed by our Refund Policy.

Viliante SMS Program

If you provide your mobile number and expressly opt in, you agree to receive recurring text messages from Viliante LLC regarding orders, delivery updates, sample requests, and customer support.

Message frequency varies. Message and data rates may apply. Consent to receive text messages is not a condition of purchase.

You may opt out at any time by replying STOP. After you reply STOP, you may receive a final confirmation message and will no longer receive recurring Viliante text messages unless you opt in again.

During an inbound phone call, Viliante may ask whether you would like us to text the Viliante order link to the mobile number you are calling from. The order link is sent only after you give clear affirmative verbal consent. This verbal consent authorizes only the customer-requested one-time order-link SMS and does not enroll you in the recurring Viliante SMS Program.

Carriers are not liable for any delayed or undelivered messages.

Website Content & Intellectual Property

The Viliante website and its content, including text, graphics, logos, product images, videos, design elements, trademarks, and other materials, are owned by or licensed to Viliante and are protected by applicable intellectual property laws.

You may use the website for personal or legitimate business purchasing purposes. You may not copy, reproduce, distribute, modify, publish, sell, exploit, scrape, or commercially use our content without prior written permission, except where permitted by law.

Prohibited Uses

You may not use our website or services to violate applicable law, infringe intellectual property or privacy rights, transmit malicious code, interfere with website security or operation, collect information unlawfully, impersonate another person, submit fraudulent orders, or engage in abusive, deceptive, or harmful activity.

We may suspend or restrict access to our services when we reasonably believe these Terms have been violated or when necessary to protect customers, Viliante, Shopify, payment providers, carriers, or other parties.

Third-Party Services & Links

Our services may use or link to third-party platforms, payment providers, shipping carriers, applications, or websites. Viliante does not control third-party services and is not responsible for their independent content, availability, security, terms, or privacy practices.

Viliante's online store is powered by Shopify. Purchases made through the Viliante store are transactions between you and Viliante LLC, not Shopify, except to the extent Shopify separately provides a service directly to you.

Errors & Service Availability

We may correct errors, inaccuracies, or omissions and update information at any time, including information relating to product descriptions, pricing, promotions, shipping charges, transit times, and availability.

We do not guarantee that the website or every feature will always be available, uninterrupted, secure, or error-free. We may modify, suspend, or discontinue parts of the services when reasonably necessary.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and services are provided on an "as is" and "as available" basis. Except for warranties that cannot legally be excluded, Viliante disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Nothing in these Terms limits any rights or warranties that cannot be waived under applicable consumer-protection law.

Limitation of Liability

To the fullest extent permitted by applicable law, Viliante LLC and its affiliates, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of the website, services, or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold Viliante LLC harmless from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of the services, your violation of these Terms, or your infringement of another person's rights.

Termination

You may stop using our services at any time. We may suspend or terminate access to the services when reasonably necessary because of a violation of these Terms, suspected fraud, abuse, security concerns, legal requirements, or risks to Viliante or others.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law, will continue to apply.

Severability & Waiver

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

A failure by Viliante to enforce a provision of these Terms does not waive our right to enforce that provision later.

Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices, legal requirements, or policies. The current version will be posted on this page with an updated effective date.

Your continued use of the services after an updated version becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.
